What Is Foreclosure?

Foreclosure is the legal process that a lender must go through to recover a loan that is in default. In order to foreclose, the lender must first get a court order.

There are several steps that must be completed before the foreclosure process can even begin. The lender must first issue a Notice of Default, which informs the borrower that they are in default and that they have a certain time frame to either pay the missed payment or bring the account current. The lender must then wait a certain amount of time before issuing a Notice of Delinquency, which gives the borrower a specific period to bring the account current. If the borrower does not bring the account current, the lender will issue a Notice of Intent to Foreclose, which gives the borrower a certain time frame to either sell the property or bring the account current.

If the borrower does not bring the account current, the lender will file a foreclosure lawsuit. The borrower will then have a certain amount of time to file an answer to the lawsuit, or they will lose by default and the court will issue an order of foreclosure. The foreclosure sale will then be held and the proceeds will be used to pay the lender the amount owed on the loan, as well as any costs involved in the foreclosure process.

Any funds remaining will be used to pay off the junior liens on the property. If there are not enough funds to pay off the junior liens, the property will be sold at a public auction to pay the junior lienholders. The property can then be sold by the lender as a real estate-owned (REO) property.

Note that the borrower can still redeem the property even after the foreclosure sale, but they must act quickly. The redemption period begins when the property is sold at the foreclosure sale. Redemption means that the borrower must pay the lender the amount of the foreclosure sale, plus any costs and fees, in order to get the property back. The redemption period lasts for a certain period of time, which will be stated in the foreclosure notice.
